The Registrar General of the Corporate Affairs Commission (CAC), Hussain Ishaq Magaji, SAN, has formally requested the Attorney General of the Federation, Lateef Fagbemi, for permission to prosecute the Nigerian Law Society and other corporate entities operating without proper registration.
In a letter dated August 15, Magaji outlined the need for approval to pursue legal action against entities violating the Companies and Allied Matters Act No. 3 of 2020.
The correspondence, marked CAC/RG/FMOJ/060/2024/Vol.llt and titled “REQUEST FOR FIAT OR CONSENT TO EXERCISE PROSECUTORIAL POWERS OF THE ATTORNEY GENERAL OF THE FEDERATION IN SECTION 174 OF THE 1999 CONSTITUTION MADE PURSUANT TO SECTION 104 (2) OF THE ADMINISTRATION OF CRIMINAL JUSTICE ACT, 2015,” aims to combat significant fraud in corporate administration.

The letter requests consent for both general prosecution and specifically against Trustees of the Nigerian Law Society for operating without registration, in violation of section 863 (2) of CAMA 2020. This move seeks to enhance regulatory enforcement and ensure compliance among registrable entities.
